David Murphy represents clients in all aspects of labor and employment law as well as in general civil litigation. David's experience covers virtually every workplace employment issue and dispute, including trade secret, non-competition, and employee-raiding matters; wrongful termination, harassment, and discrimination litigation; wage and hour matters under state and federal law; ERISA litigation; and all of the many varieties of union-related disputes. David has extensive trial and appellate work in state and federal court. As lead trial attorney, David has led in over 75 trials, arbitrations and contested administrative hearings.

David has a thorough understanding and appreciation of Silicon Valley communities, especially the highly active technology businesses. David provides a wide range of sophisticated legal services in labor and employment law, trade secrets law, and employee mobility matters for private sector employers, particularly Silicon Valley, counseling and civil litigation matters.

David has done extensive work on employment issues in mergers and acquisitions, which particularly include issues involved in post-closing integration of multiple company workforces and, therefore, most importantly how to handle executives and their employment issues. In addition, David has extensive knowledge and experience in drafting executive employment agreements of all types, both in the general merger and acquisition setting, but also in representing individual executives in their own negotiations.

In the past decade, David has also developed an excellent understanding and reputation for handling trade secret misappropriation, employee raiding and general non-competition agreement issues. California has a highly unique approach to these issues, and David understands the great significance of properly handling these matter for executives. David has practical working experience in all aspects of drafting the related agreements and litigating the related issues.
